Telegram CEO Pavel Durov was arrested on August 24th 2024 in France on charges related to use of the messaging platform:

The first preliminary charge against him was for ‘’complicity in managing an online platform to allow illicit transactions by an organized group,’' a crime that can lead to sentences of up to 10 years in prison and 500,000 euro fine, the prosecutor’s office said.

The arrest has brought significant public attention to Telegram use by dissidents and other non-state actors, including criminal individuals, organizations, and institutions. The platform is also used in international and non-international armed conflict:

The geopolitical implications of Durov’s detention cannot be overlooked. Telegram has been a critical tool in several global hotspots, most notably the Ukraine conflict, where it has been used by both military units and civilians for communication and information dissemination. Russia’s immediate response, demanding consular access and criticizing French authorities, underscores the international tensions at play.

During the outbreak of Covid-19, freedoms were sharply curtailed with draconian constraints on civil liberties and private enterprise. The arrest and charging of Telegram founder Pavel Durov "raises a lot of human rights concerns" says a spokesperson for the UN Human Rights Office Ravina Shamdasani. Russian-born Durov was detained in France on 24 August and charged with violations related to the messaging app. Speaking to reporters at a weekly UN briefing, Shamdasani explains that any restrictions on social media need to be "in line with international human rights standards."

Telegram has subsequently removed its warrant canary from publication:

Telegram has quietly removed language from its FAQ page saying private chats were protected and that “we do not process any requests related to them.” The change comes nearly two weeks after its CEO, Pavel Durov, was arrested in France for allegedly allowing “criminal activity to go on undeterred on the messaging app."

In response, Telegram spokesperson Remi Vaughn says the app’s source code has not changed. “Private chats are still private too – although you could always report a new incoming chat to moderators by using Block > Report. Anyone can check Telegram’s open source code and see there were no changes,” writes Vaughn in a statement shared with The Verge.

Earlier on Thursday evening, Durov issued his first public statement since his arrest, promising to moderate content more on the platform, a noticeable change in tone after the company initially said he had “nothing to hide.”

This follows allegations from Der Spiegel that Telegram was already providing user details to the German Bundeskriminalamt:

Contrary to what has been publicly stated, the operators of the messenger app Telegram have released user data to the Federal Criminal Police Office ( BKA ) in several cases. According to SPIEGEL information, this involved data on suspects in the areas of child abuse and terrorism. When it comes to violations of other crimes, it is still difficult for German investigators to obtain information from Telegram, security circles say.

In recognition and in accordance with these events, a general warrant canary with PGP signature verification has been added to the Terms and Conditions of the Company.

The Company reiterates that the establishment of this warrant canary for Throne Dynamics is solely related to these ongoing external events and is not in response to any interaction or engagement with the Company and its operations in the past, present, or anticipated future.

It is a normal, demanded, and iterative process to maintain freedom of expression and furtherance of human rights in the face of oppressive State action. In these opening months and years of the Third World War it is incumbent upon individuals, organizations, and institutions to be aware of broader changes and predictable efforts by rotted States to maintain control amid collapse.
